General terms and conditions:

1) Unless otherwise expressly agreed, the following general terms and conditions apply to all business between the Tyrolean Ski and Snowboard School Perl Michael and its customers. This includes services such as giving ski instruction and guiding and accompanying alpine skiing.

1a. General conditions of participation: The contractual partner must inform the ski instructor truthfully and comprehensively about his abilities and experience with regard to skiing, as well as independently ensure that the equipment is in accordance with the state of the art of skiing technology and the external conditions. He must also inform the ski instructor about his physical abilities, in particular his state of health and any ailments. Before the start of the instruction, the contractual partner must independently arrange for the ski equipment (in particular ski bindings) to be checked by a specialist company.

1b. Terms of payment: The Tyrolean Ski and Snowboard School Perl Michael is free to request a deposit of at least 50% of the invoice amount by bank transfer after a written booking confirmation.
The invoice amount is due within 10 calendar days after receipt of the invoice. The amount can be paid in cash or by bank transfer. In the event of late payment by the invoice recipient, we are entitled to charge interest on arrears at a rate of 5% per annum.

1c. Cancellations: Cancellations up to one month before the first ski day are free of charge. Cancellations from one month before the first day of skiing will be charged 80% of the agreed rate. Bad weather conditions are no reason for cancellation. In the event of cancellation due to accident or illness during the skiing holiday, a certificate from a local doctor must be presented so that the corresponding days are not charged.

1d. Liability: In principle, the Tyrolean Ski and Snowboard School Perl Michael is only liable for damages directly related to the activity of ski teaching or ski guiding and which were caused intentionally or by gross negligence. A corresponding professional liability insurance exists. Furthermore, the Tyrolean Ski and Snowboard School Perl Michael is in no case liable if the contractual partner injures himself/herself, suffers damages or causes damages of any kind by disregarding the instructions, the FIS piste rules or other legal orders. The contract partner is strongly recommended to take out health, accident and liability insurance.

1e. Choice of law: Austrian law applies.

1f. Place of jurisdiction: The place of performance is the location of the branch of the Tyrolean Ski and Snowboard School Perl Michael.
For all legal disputes arising from the contractual relationship, the court which is locally and objectively competent at the location of the branch of the Tyrolean Ski and Snowboard School Perl Michael is responsible.

Nevertheless, the owner excludes a guarantee for direct or indirect damages of any kind, which are caused by errors or missing information. The website is only intended to initiate communication and has no influence on the booking or reservation process. Details such as meeting point, time, payment methods, deposit or special services are without exception agreed upon with the ski instructor / ski guide himself and are not subject of this internet page – i.e. a contract is exclusively concluded between guest and guide, but not with the owner of this website.
